We believe that skilled workers who move to Canada should have the right to own property to live in and not for speculative purposes.<\/p>\n<p id=\"\">We invite you to sign\u00a0<a id=\"\" href=\"https:\/\/www.change.org\/p\/le-1er-janvier-2023-la-loi-sur-l-interdiction-%C3%A0-l-achat-immobilier-par-les-non-canadiens-va-entrer-en-vigueur-que-signifie-cela-pour-les-acheteurs-ayant-le-statut-de-r%C3%A9sident-permanent-temporaire-%C3%A9tudiants?recruiter=893724573&amp;utm_source=share_petition&amp;utm_medium=sms&amp;utm_campaign=share_petition&amp;utm_term=share_petition&amp;recruited_by_id=44b811c0-9e7b-11e8-9fe2-050c3983f8a9\">this petition to challenge the law to prohibit the purchase of real estate by non-Canadians<\/a>.<\/p>\n<p id=\"\"><strong id=\"\">UPDATE : 31\/01\/23<\/strong><\/p>\n<p id=\"\">On January 31, 2023, the court stated in its judgment that\u00a0<strong>promises to purchase and sell\u00a0<\/strong>entered into by a non-Canadian\u00a0<strong>before January 1, 2023\u00a0<\/strong>are not covered by the law prohibiting the purchase of residential real estate by a non-Canadian.<\/p>\n<p id=\"\">Therefore, if you are a non-Canadian and you signed a promise to purchase or sell before January 1, 2023, you can still proceed with the purchase or sale of this property despite the implementation of this new law.<\/p>\n<p id=\"\">We will be sure to update our articles as we receive information.<\/p>\n<h2 id=\"\">What does this law say?<\/h2>\n<p id=\"\">As a reminder, the Act prohibits non-Canadians from purchasing residential real estate in Canada for a\u00a0period\u00a0of 2 years as of January 1, 2023, with some exceptions.<\/p>\n<h2 id=\"\">Definitions to remember<\/h2>\n<h3 id=\"\">The term &#8220;non-Canadian&#8221;<\/h3>\n<p id=\"\">Non-Canadian&#8221; should be understood as anyone who is not ;<\/p>\n<ul id=\"\">\n<li id=\"\">Canadian citizen<\/li>\n<li id=\"\">permanent resident<\/li>\n<li id=\"\">native<\/li>\n<\/ul>\n<p id=\"\">The same applies to all companies located in Canada that are ;<\/p>\n<ul id=\"\">\n<li id=\"\">private<\/li>\n<li id=\"\">controlled by a non-Canadian<\/li>\n<\/ul>\n<h3 id=\"\">A &#8220;residential building&#8221;.<\/h3>\n<p id=\"\">The ban includes:<\/p>\n<ul id=\"\">\n<li id=\"\">detached or similar one- to three-unit detached houses<\/li>\n<li id=\"\">semi-detached houses<\/li>\n<li id=\"\">condominiums<\/li>\n<li id=\"\">vacant land where the land has been selected for residential or mixed use and is located in a metropolitan area or census agglomeration. We invite you to check the\u00a0<a id=\"\" href=\"https:\/\/www12.statcan.gc.ca\/census-recensement\/2021\/geo\/maps-cartes\/referencemaps-cartesdereference\/cma_ca_ct-rmr_ar_sr\/index2021-fra.cfm?year=21\">Statistics Canada census tract reference map<\/a>\u00a0to see if your residential property is located in a metropolitan area or census agglomeration.<\/li>\n<\/ul>\n<h2 id=\"\">What are the exceptions to this law?<\/h2>\n<ul id=\"\">\n<li id=\"\">permanent residents<\/li>\n<li id=\"\">the temporary resident, under conditions :<\/li>\n<\/ul>\n<p id=\"\">&#8211; have a valid study permit, as long as these conditions are met:<\/p>\n<p id=\"\">\u2192file all tax returns for the 5 tax years prior to the purchase<\/p>\n<p id=\"\">\u2192 be present on Canadian territory at least 244 days per year for the last 5 years prior to the purchase<\/p>\n<p id=\"\">\u2192 the purchase price must not exceed $500,000<\/p>\n<p id=\"\">\u2192 only one residential property must be purchased<\/p>\n<p id=\"\">&#8211; to have a work permit, as long as these conditions are met:<\/p>\n<p id=\"\">\u2192 the employment was full-time for at least 3 years during the 4 years prior to the purchase<\/p>\n<p id=\"\">\u2192 file all tax returns for at least 3 years in the 4 years prior to purchase<\/p>\n<p id=\"\">\u2192 only one residential property must be purchased<\/p>\n<ul id=\"\">\n<li id=\"\">refugees<\/li>\n<li id=\"\">a non-Canadian who purchases a residential property with his or her spouse or common-law partner, as long as the spouse or common-law partner is eligible to purchase a property in Canada<\/li>\n<li id=\"\">accredited persons from a foreign mission who have a valid diplomatic, consular, official or special representative acceptance issued by the Chief of Protocol of Canada.<\/li>\n<li id=\"\">in case of acquisition of the property through inheritance, gift, divorce or separation<\/li>\n<li id=\"\">in the case of a\u00a0transfer\u00a0from a trust created before January 1, 2023<\/li>\n<li id=\"\">in the event of a\u00a0transfer\u00a0under a security interest or other secured interest<\/li>\n<\/ul>\n<h2 id=\"\">FAQ<\/h2>\n<h3 id=\"\">Are purchase requests submitted after January 1, 2023 valid?<\/h3>\n<p id=\"\"><strong id=\"\">UPDATE : 31\/01\/23<\/strong><\/p>\n<p id=\"\">On January 31, 2023, the court stated in its judgment that promises to purchase and sell entered into by a non-Canadian before January 1, 2023 are not covered by the law prohibiting the purchase of residential real estate by a non-Canadian.<\/p>\n<p id=\"\">Therefore, if you are a non-Canadian and you signed a promise to purchase or sell before January 1, 2023, you can still proceed with the purchase or sale of this property despite the implementation of this new law.<\/p>\n<p id=\"\">We will be sure to update our articles as we receive information.<\/p>\n<h3 id=\"\">Is any application for a mortgage refinance or transfer by a non-Canadian still valid?<\/h3>\n<p id=\"\">Yes, all transactions that do not involve a purchase are still valid for a non-Canadian.<\/p>\n<h3 id=\"\">Are U.S. residents in Canada covered by the exceptions to the Act?<\/h3>\n<p id=\"\">No, not all U.S. resident buyers who do not qualify\u00a0as\u00a0&#8220;Canadian&#8221; are exempt from this ban.<\/p>\n<h3 id=\"\">What impact does the Act have on mortgage pre-approvals or conditional approvals for purchases?<\/h3>\n<p id=\"\">From now on, any application for mortgage pre-approval is subject to the same restrictions and exceptions set forth in this Act.<\/p>\n<h3 id=\"\">Is there an impact on unsecured loans?<\/h3>\n<p id=\"\">This Act does not affect unsecured loans.<\/p>\n<h3 id=\"\">Are four-unit multiplexes affected by this law?<\/h3>\n<p id=\"\">No, the Act defines residential buildings as consisting of no more than three units. Therefore, four-unit multiplexes are permitted to be purchased by a non-Canadian.<\/p>\n<h3 id=\"\">Are cottages or second homes affected by this ban?<\/h3>\n<p id=\"\">The purpose for which your property is used does not determine whether or not you are allowed to purchase.
