{"id":17246,"date":"2023-01-11T01:23:28","date_gmt":"2023-01-11T01:23:28","guid":{"rendered":"https:\/\/hypotheques.ca\/blogue\/tout-sur-la-loi-interdiction-a-lachat-immobilier-par-les-non-canadiens\/"},"modified":"2023-07-19T19:32:02","modified_gmt":"2023-07-19T19:32:02","slug":"what-you-need-to-know-about-the-prohibition-of-real-estate-purchases-by-non-canadians-act","status":"publish","type":"post","link":"https:\/\/hypotheques.ca\/en\/blog\/what-you-need-to-know-about-the-prohibition-of-real-estate-purchases-by-non-canadians-act\/","title":{"rendered":"What you need to know about the Prohibition of Real Estate Purchases by Non-Canadians Act"},"content":{"rendered":"<p id=\"\">On January 1, 2023, the law prohibiting the purchase of residential real estate by non-Canadians will come into effect. This law prohibits for a period of 2 years all purchases of real estate in Canada by non-Canadians.<\/p>\n<p id=\"\">On December 9, the government published a regulation to clarify the exceptions to this prohibition.<\/p>\n<p id=\"\">Our mortgage brokers explain in detail the exceptions to this prohibition conditioned by the December 9, 2022 regulation.<\/p>\n<p id=\"\">Thus, this regulation establishes that this prohibition does not include:<\/p>\n<ul id=\"\">\n<li id=\"\">permanent residents<\/li>\n<li id=\"\">the\u00a0<strong id=\"\">temporary resident, under conditions<\/strong>:<\/li>\n<\/ul>\n<p id=\"\">&#8211; have a valid study permit, as long as these conditions are met:<\/p>\n<p id=\"\">\u2192file all\u00a0<strong id=\"\">tax returns for the 5 tax years prior to the purchase<\/strong><\/p>\n<p id=\"\">\u2192 be\u00a0<strong id=\"\">present on Canadian territory at least 244 days per year for the last 5 years prior to the purchase<\/strong><\/p>\n<p id=\"\">\u2192 the purchase price must not exceed\u00a0<strong id=\"\">$500<\/strong>,000<\/p>\n<p id=\"\">\u2192\u00a0<strong id=\"\">only one residential property\u00a0<\/strong>must be purchased<\/p>\n<p id=\"\">&#8211; to have a work permit, as long as these conditions are met:<\/p>\n<p id=\"\">\u2192 the employment was<strong id=\"\">\u00a0full-time for at least 3 years during the 4 years prior to the purchase<\/strong><\/p>\n<p id=\"\">\u2192 file all\u00a0<strong id=\"\">tax returns for at least 3 years in the 4 years prior to purchase<\/strong><\/p>\n<p id=\"\">\u2192\u00a0<strong id=\"\">only one residential property<\/strong>\u00a0must be purchased<\/p>\n<ul id=\"\">\n<li id=\"\">refugees<\/li>\n<li id=\"\">a non-Canadian who purchases a residential property with his or her spouse or common-law partner, as long as the spouse or common-law partner is eligible to purchase a property in Canada<\/li>\n<li id=\"\">foreigners who have a valid acceptance as a diplomat, consular officer, civil servant or special representative<\/li>\n<li id=\"\">in case of acquisition of the property through inheritance, gift, divorce or separation<\/li>\n<li id=\"\">in the case of a\u00a0transfer\u00a0from a trust created before January 1, 2023<\/li>\n<li id=\"\">in the event of a\u00a0transfer\u00a0under a security interest or other secured interest<\/li>\n<\/ul>\n<p id=\"\">\u200d<\/p>\n<p id=\"\">All professionals such as notaries, lawyers, real estate and mortgage brokers are required to inform their clients of this prohibition and the resulting exceptions.<\/p>\n<p id=\"\">If you violate this prohibition, you and anyone who assisted you are subject to a fine of up to $10,000 and your property may be forcibly sold.<\/p>\n<p id=\"\">However, the order of sale cannot be issued if these 3 conditions are met:<\/p>\n<ul id=\"\">\n<li id=\"\">the non-Canadian owns the residential property at issue at the time of the order of sale<\/li>\n<li id=\"\">notice has been given to persons who may have an interest in the property in question<\/li>\n<li id=\"\">the court before which the matter is brought finds that the impact of an order of sale is not disproportionate to the contravention<\/li>\n<\/ul>\n<p id=\"\">With respect to purchase and sale agreements signed before January 1, 2023, these may be entered into after the implementation of the Prohibition Act.<\/p>\n<p id=\"\">Our brokers believe that this legislation is not appropriate, especially for temporary residents who should have the opportunity to move to Canada with their families.\u00a0<strong id=\"\">We believe that skilled workers who move to Canada should have the right to own property to live in and not for speculative purposes.<\/strong><\/p>\n<p id=\"\">We invite you to sign\u00a0<a id=\"\" href=\"https:\/\/www.change.org\/p\/le-1er-janvier-2023-la-loi-sur-l-interdiction-%C3%A0-l-achat-immobilier-par-les-non-canadiens-va-entrer-en-vigueur-que-signifie-cela-pour-les-acheteurs-ayant-le-statut-de-r%C3%A9sident-permanent-temporaire-%C3%A9tudiants?recruiter=893724573&amp;utm_source=share_petition&amp;utm_medium=sms&amp;utm_campaign=share_petition&amp;utm_term=share_petition&amp;recruited_by_id=44b811c0-9e7b-11e8-9fe2-050c3983f8a9\">this petition to challenge the law to prohibit the purchase of real estate by non-Canadians\u00a0<\/a>.<\/p>\n<p id=\"\">\n<p id=\"\">For more information or questions, we invite you to contact our mortgage brokers at (514) 447-3000 or by\u00a0<a id=\"\" href=\"https:\/\/calendly.com\/d\/g6k-yhq-zyh\">appointment<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On January 1, 2023, the law on the prohibition of real estate purchases by non-Canadians will come into effect.
